Terms of Service

These Terms of Service ("Terms") govern your use of the MITRAT platform operated by Mitr Companies Pty Ltd (ABN 96 689 165 240) ("MITRAT", "we", "us"). By accessing or using MITRAT, you agree to be bound by these Terms. If you do not agree, do not use the platform.

MITRAT is a provider-discovery and comparison platform that connects NDIS participants, service providers, and support coordinators. We provide a directory and communication platform — we do not provide NDIS services directly, employ service providers, or make funding decisions.

To use certain features, you must create an account. You agree to:

• Provide accurate and current information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorised access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

If you register as a service provider on MITRAT, you agree that:

• All information provided (business name, ABN, services, contact details) is accurate and current
• You hold all necessary registrations, certifications, and insurance required to deliver your services
• You will keep your listing updated, including capacity status and availability
• Your listing is subject to review and approval by MITRAT administrators
• We may reject, suspend, or remove listings that are inaccurate, misleading, or non-compliant
• You are solely responsible for the services you provide to NDIS participants
• You will comply with all NDIS Quality and Safeguards Commission requirements

MITRAT offers the following listing tiers:

• Free: Basic provider listing with core contact details and service categories
• Rental Space ($99/year): Enhanced storefront with gallery, team section, events, daily deals, analytics, lead management, resource uploads, and boosted ranking

Subscription fees are non-refundable except as required by Australian Consumer Law. We reserve the right to modify pricing with 30 days' notice. A small lead fee may apply when providers receive direct participant enquiries through the platform.

If you use MITRAT as an NDIS participant or their representative, you acknowledge that:

• MITRAT is a directory and comparison platform — we do not recommend, endorse, or guarantee any provider
• You are responsible for verifying provider suitability, qualifications, and NDIS registration
• Any agreements for services are between you and the provider directly
• MITRAT is not liable for the quality, safety, or outcome of services arranged through the platform
• You should consult your support coordinator or plan manager before making service decisions

Support coordinators using MITRAT agree to:

• Act in the best interest of their participants at all times
• Only share participant information with explicit consent
• Use the job posting and shortlisting features responsibly
• Not accept undisclosed commissions or incentives from providers listed on MITRAT

All users of forums, reviews, and messaging features must:

• Be respectful and constructive in all interactions
• Not post false, defamatory, or misleading content
• Not share personal or sensitive information about others without consent
• Not engage in spam, harassment, or solicitation
• Not impersonate other users or organisations

We reserve the right to moderate, edit, or remove content that violates these guidelines. Repeated violations may result in account suspension.

The MITRAT platform, including its design, code, branding, and content, is owned by Mitr Companies Pty Ltd. You retain ownership of content you upload (logos, images, descriptions) but grant us a non-exclusive, royalty-free licence to display it on the platform for the purpose of operating the platform.

To the maximum extent permitted by law:

• MITRAT is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free access
• We are not liable for any loss or damage arising from your use of the platform
• We are not liable for the actions, omissions, or services of providers listed on MITRAT
• Our total liability for any claim is limited to the fees you have paid us in the preceding 12 months

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

You agree to indemnify and hold harmless Mitr Companies Pty Ltd, its directors, employees, and agents from any claims, losses, or damages arising from your use of MITRAT, your breach of these Terms, or your violation of any third-party rights.

You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. Upon termination, your provider listing will be removed and your data handled in accordance with our Privacy Policy.

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria. We encourage resolution through direct communication before pursuing formal legal action.

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the platform. Continued use of MITRAT after changes constitutes acceptance of the updated Terms.
